Company Title

Company Title is a common form of property ownership in New South Wales.  It differs from more common forms of title such as Torrens Title and Strata Title in that Company Title ownership is attained through ownership in shares in a corporate entity (or Company) which is incorporated with the Australian Securities an Investment Commission (ASIC).

Essentially, the Company Title owner has the right to occupy a defined area in the company’s building (e.g., Apartment 12) by virtue of owning a set number of shares in the company which in turn owns the entire building.

The main features of Company Title are:

  • The company owns the land and buildings
  • Individual shareholders in the company have the right to occupy a particular part of the building
  • Control of the building is vested in the company's board of directors
  • The company's articles of association regulate the company including the management of the building and rights of shareholders
